Abstract

The slowness of the judicial system is a chronic concern in Brazil, affecting the ability to provide effective justice and universal access to justice. This study examines this issue, with a special focus on the Kiss Nightclub tragedy, which experienced considerable delays in its judicial process. The objective of this paper is to analyze the slowness of the Brazilian judicial system, identifying its main causes and consequences, as well as the measures adopted to address it, based on the Kiss Nightclub case. A qualitative and descriptive research was conducted, using document analysis and literature review as the main methods. The Kiss Nightclub case serves as a case study to illustrate the challenges of the Brazilian judicial system in complex cases. The main causes of delays include excessive bureaucracy and procedural formalities, lack of resources and adequate infrastructure, and inefficiency in the management of judicial processes. The consequences include lack of access to justice and a sense of impunity. Measures to combat delays involve legislative reforms and the use of faster trial techniques, such as mediation and conciliation. The slowness of the Brazilian judiciary is a persistent challenge that harms society and access to justice. The Kiss nightclub case exemplifies how slowness in the legal system can prolong the suffering of victims. To address this issue, legislative reforms and the promotion of alternative dispute resolution methods are crucial steps. However, substantive change requires a continued commitment to efficiency and universal access to justice for all Brazilian citizens.
